Note
*1) Following the Court of Appeal's decision in Thomas and others the
Secretary of
State appealed to the House of Lords. A doubt existed as to the Secretary
of State's power to suspend benefit. It was conceded that until a final
decision was made on the cases, women claimants should be paid Severe Disablement
Allowance and Invalid Care Allowance on the same basis as men. The European
Court has now ruled on the substantive issues and has remitted the case
back to the House of Lords for final determination. |
